WORKERS COMPENSATION UPDATE: EXPERT WITNESS CODE OF CONDUCT

On 1 June 2023 the Tasmanian Civil and Administrative Tribunal (TASCAT) issued a practice direction requiring that expert witnesses engaged for the purposes of matters before the General Division of the Tribunal (which includes workers compensation) must be aware of and agree to comply with an expert witness Code of Conduct.

As a consequence of this practice direction the parties to workers compensation matters and their representatives should now take steps to ensure that any experts that are instructed for or in anticipation of a TASCAT referral are provided with a copy of the Expert Witness Code of Conduct so that the expert can ensure that their report complies with the requirements set out in the Code.
